Whistleblowers Against Fraud Discusses Ramifications of First Supreme Court Whistleblower Case

On Nov. 4, oral arguments began in a case that involves an air force marshal who lost his job in 2006. The air force marshal had complained to an agency supervisor and the Department of Homeland Security's Office of the Inspector General about what he considered to be a cost-cutting and dangerous decision by the Transportation Security Administration (TSA) in 2003. The decision was to cancel overnight stays for training soldiers to prevent Al-Qaeda suicidal hijacking plots. The Air Force marshal also disclosed this information to an MSNBC reporter.
The Obama Administration argued that the sensitive nature of the air marshal's disclosures was prohibited under agency regulations and the Federal Aviation and Transportation Security Act. The U.S. Court of Appeals ruled in Apr. 2013 in favor of the air marshal, deciding the law did not specifically prohibit his statements. However, the court did not rule on whether the Whistleblower Protection Act covered the Air Force marshal. This legislation protects employees who disclose unlawful conduct, gross mismanagement or threats to public safety.
Last May, at the end of the U.S. Supreme Court's last term, the court agreed to hear the Obama Administration's appeal and rule on whether the Whistleblower Protection Act applies. The court's current term began this month and ends in June 2015.
This Supreme Court case has major implications on the whistleblower program. The U.S. Office of Special Counsel (OSC) warns that if the court rules against the Air Force marshal, it could prevent whistleblowers from coming forward in the future.
